QCAT matter types

From 1 December 2009 QCAT will deal with these types of matters:

Guardianship for adults
Declaring an adult’s decision making capacity and appointing a responsible adult to make some or all personal and health care decisions for the adult, ensuring their rights are protected.  Adult guardianship matters are currently dealt with by the Guardianship and Administration Tribunal.

Administration for adults
Declaring an adult’s decision making capacity and appointing a responsible adult to make some or all financial and legal decisions for the adult, ensuring their rights are protected. Adult administration matters are currently dealt with by the Guardianship and Administration Tribunal.

Residential tenancy disputes
A wide range of disputes between tenants, landlords and agents about residential properties and between residents, providers of and agents for rooming accommodation. Residential tenancy disputes are currently dealt with by the Small Claims Tribunal.

Debt disputes
Disputes against another person, business or company about a fixed or agreed sum of money valued up to and including $25,000, for example unpaid wages, an IOU or money lent and not repaid. Debt disputes are currently dealt with by the Magistrates Court.

Consumer disputes
Disputes valued up to and including $25,000 arising out of a contract for the supply of goods and services including the repair of a defect in a motor vehicle. Consumer disputes are currently dealt with by the Small Claims Tribunal.

Minor civil disputes
Disputes valued up to and including $25,000 including debt disputes, consumer disputes, residential tenancy disputes, property damage disputes and dividing fence disputes.  Minor civil disputes are currently dealt with by the Small Claims Tribunal and the Magistrates Court.

Other civil disputes
Body corporate and community management scheme disputes, legal cost agreement claims, manufactured home park disputes, legal cost agreement claims, financial losses caused by motor and property agents and retirement village disputes. Other civil disputes are currently dealt with by the Consumer and Commercial Tribunal and the Legal Practice Tribunal.

Building disputes
Domestic and commercial building disputes, disciplinary proceedings and reviews of the Building Service Authority’s and registered adjudicator’s decisions.  Building disputes are currently dealt with by the Consumer and Commercial Tribunal.

Children and young people matters
Child protection matters, adoption applications, blue card applications and prohibiting a person from entering educational facilities. Children and young people matters are currently dealt with by the Children Services Tribunal or the Magistrates Court.

Anti-discrimination matters
Complaints of alleged sexual harassment and discrimination and associated objectionable behaviour including racial and religious vilification and victimisation. Also granting exemptions, reviewing decisions made by the Anti-Discrimination Commissioner and providing opinions related to anti-discrimination matters.  Anti-discrimination matters are currently dealt with by the Anti-Discrimination Tribunal.

Occupational regulation matters
Disciplinary proceedings and licensing decisions for architects, building personnel, health practitioners, introduction agents, legal practitioners, motor dealers, nursing practitioners, plumbers and drainers, prescribed persons who are public servants or police officers, professional engineers, property agents, racing personnel, second-hand dealers and pawnbrokers, security providers, surveyors, teachers, tour operators, travel agents, valuers and veterinary surgeons.

Occupational regulation matters are currently dealt with by a range of tribunals and bodies including the Consumer and Commercial Tribunal, Health Practitioners Tribunal, Legal Practice Tribunal, Misconduct Tribunal, Nursing Tribunal, Racing Appeals Tribunal, Surveyors Disciplinary Committee, Teachers Disciplinary Committee, Valuers Registration Board, Valuers Registration Committee and the Veterinary Tribunal.

Retail tenancy disputes
A wide range of retail shop lease disputes. Retail shop lease disputes are currently dealt with by the Retail Shop Leases Tribunal.

Administrative decisions
Decisions made by government agencies and other bodies including statutory authorities.  

Reviews of administrative decisions are currently dealt with by the Local Government Appeal Tribunal (decisions about levee banks), Commercial and Consumer Tribunal, Fisheries Tribunal, Gaming Commission, Independent Assessor, Fire Panel of Referees, Racing Appeals Tribunal, Supreme Court, District Court and the Magistrates Court.
